Dr M H Halperin, who supervised assembling of Pentagon papers, testifies on March 22 at Pentagon trial that in his opinion release of papers was not injurious to US because group that compiled papers did not have access to White House papers on war, nor to minutes of White House meetings, nor to memorandums between then Sec of State D Rusk and Presidents Kennedy and Johnson; holds papers do not present authorative view of thinking at highest levels of Govt about Vietnam war; says most high Govt officials express their true personal views of war in 'private conversations' or in memorandums circulated to only 2 or 3 persons; says that 1 of themes that ran through papers was what Govt had to tell Amer public 'to maintain support of the war'; says another theme was US's reluctance to begin negotiations to end the war; repts after papers were 1st disclosed in NY Times in June he turned over his set of them to Natl Archives

Dr M H Halperin, who had gen supervision of Defense Dept group that put together Pentagon papers, testifies on March 21 at Pentagon papers trial that 1 copy of papers had been sent to Rand Corp for storage and that it did not belong to US Govt; says he classified papers 'top secret-sensitive' in routine manner because everything relating to war in Vietnam had been classified 'top secret' in dept; says he considered materials including 1 set of papers, as being private papers of himself, L Gelb, who headed Pentagon papers study, and P C Warnke, then Asst Sec of Defense for Internal Security; says that 1 reason 3 men wanted information stored in special way at Rand was so that other officials in Govt would not learn of existence of papers when Govt inventories of 'top secret' documents at Rand were made; says that he and Gelb gave D Ellsberg right to have special access to papers for study he was doing on Vietnam; says word 'sensitive' was added to 'top secret' because then Sec of Defense, R S McNamara, considered documents 'bureaucratically and politically sensitive' and did not want their existence to be known 'within the executive branch as well as outside, except to those who were working on papers'; says he had made no attempt to determine whether source docuemnts on which papers were based had been properly classified, nor did he other to read various classification regulations

US Dist Ct Judge Richey, acting on 1st Amendment grounds, quashes subpoenas served on reprs of 4 news orgns by Com for Re-Election of Pres which demanded that 10 reporters and news execs turn over notes and other unpublished material in Watergate case; says Nixon com lawyers made no showing that other sources of evidence 'have been exhausted or approached' and that they failed to show that material demanded of journalists is central to case; journalists' lawyers and Judge Richey note that current case, unlike most of those in which cts have ordered testimony to be given, is civil action with fewer competing needs than criminal case would have; Dem Natl Com and party leaders are demanding $3.2-million in damages from Nixon orgn and others in connection with break-in and bugging of Watergate; Repubs charge former Dem Natl Chmn L F O'Brien with libel and malicious abuse of judicial process; reporters subpoenaed include J M Crewdson (NY Times), C Bernstein, B Woodward, Mrs K Graham and H Simons (Washington Post), J O'Leary, P Collins and J Polk (Washington Star-News) and D Fisher (Time)
