Judge Byrne releases testimony of E H Hunt Jr given before grand jury investigating Watergate break-in, concerning plot to break info office of D Ellsberg's psychiatrist Dr L J Fielding; Hunt's testimony says that break-in was conceived, supervised and paid for in White House, and CIA supplied camera and disguises; says operation was personally directed by White House staff members D Young and E Krogh Jr; CIA spokesman repts agency had no advance knowledge of any break-in at Fielding's office or of Watergate incident; says all information on contacts with persons involved in such incidents 'has been fully reported to the Justice Dept' and all inquiries should be directed to dept; Byrne denies defense motion for dismissal based on his own visits with J D Ehrlichman; takes under submission motion to dismiss on ground of Govt misbehavior for suppressing evidence and for burglary; refuses to hear arguments on whether case has been 'tainted'; says he is convinced that 'nothing has compromised my ability to act as a fair and impartial judge in this case'

Judge Byrne orders that grand jury testimony E H Hunt Jr gave on May 2 in Watergate case be turned over to him immediately; Hunt reptdly testified that he and G G Liddy, convicted in Watergate conspiracy, personally took part in break-in at office D Ellsberg's psychiatrist Dr L J Fielding on night of Sept 3-4, '71; Fed Dist Judge J J Sirica, presiding over Watergate trial, orders that 37 pages of testimony by Hunt be sent to Byrne; Byrne reiterates that 'burden is on the Government' to prove that neither Justice Dept nor White House nor Watergate conspirators had interfered with const rights of defendants Ellsberg and A J Russo and therefore 'tainted' Pentagon case; discloses that number of former high-ranking Govt officials have refused to be int by FBI in ct-ordered inquiry into link between Watergate affair and Pentagon papers trial; Ellsberg's defense attys read in open ct article in Washington Post saying that Pres Nixon had been consulted before rept of break-in at Fielding's office was turned over to Byrne, and that Atty Gen Kleindienst made desision to consult Nixon; article says that because Nixon had to be consulted there was 10-day delay between time Justice Dept admitted to learning of break-in until it was finally reptd to Byrne; attys read another Post article saying that Hunt and Liddy supervised wiretapping of at least 2 NY Times reporters in '71 as part of their investigation of Pentagon papers publication, and that this wiretapping had been authorized by then Atty Gen J N Mitchell; defense continues questioning of former Rand Corp pres H Rowen; Rowen says that set of Pentagon papers that Ellsberg and Russo are accused of Xeroxing were not logged into Rand Corp's top secret control system until Dec 31, '70, long after papers arrived at Rand; information would tend to prove Ellsberg's contention that papers had been given special treatment at Rand and that he had been given access to them; Los Angeles County Dist Atty J P Busch repts he is conducting investigation into break-in at Fielding's office
