Editors Debate Support for Magazine on Bomb Article; Supreme Court Outlook

One of most troublesome questions facing ASNE as it winds up annual convention in NYC is whether to support Progressive magazine in its fight against Federal court order prohibiting it from publishing article describing how to build hydrogen bomb; board of directors is to consider recommendation from 1 of its committees that group file brief as friend of court on behalf of Progressive on ground that Government has failed to meet heavy constitutional burden implicit in case; dilemma that editors face is that while Progressive case is 1 of most serious 1st Amendment challenges in recent years, most of them would not have published article in their own newspapers and many have serious doubts about merits of piece; 1 of difficulties in case is that much of testimony is sealed, so that it is not precisely known how Government contends material would endanger national security; Anthony Day (Los Angeles Times) and A M Rosenthal (NY Times) comment (M)

Pressure to reopen murder case of Arizona Republic reporter Don Bolles is building in Phoenix; defense committee of more than 300 people, convinced there has been injustice, has raised enough commotion to disturb even some of those who were responsible for convictions in Bolles death; committee is acting in behalf of Max Dunlap, 1 of 2 men sentenced to die for murder; committee's belief in his innocence is so strong that some members have mortgaged their homes to finance defense fund; in latest development in case affidavit was made public in which police informer Jo Don says he told Scottsdale police of plan to murder Bolles 3 or 4 weeks before it happened; police chief Walter Nimitz comments; Don, indicted on charges of selling marijuana, has been trying to bargain for immunity in exchange for his testimony in Bolles case; Roger Golston, acting County Attorney, says authorities are negotiating with idea of dropping charges against Don providing he surrender and that his story checks out; Don's affidavits echo charges made at murder trial that lawyer named Neal Roberts arranged Bolles murder
